Order Acceptance Policy
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Pexheat.com reserves the right at any time after receipt of your order to accept or decline your order for any reason. Pexheat.com reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. All orders placed must obtain pre-approval with an acceptable method of payment, as established by our credit and fraud avoidance department. We may require additional verifications or information before accepting any order.

Typographical Errors
In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, Pexheat.com shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Pexheat.com shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Pexheat.com shall immediately issue a credit to your credit card account in the amount of the charge.

REBATE COUPONS
Rebate coupon redemption is limited to ONE PER ADDRESS only, unless otherwise noted.

WARRANTY LIMITATIONS
There are no other express warranties or conditions respecting the equipment. Implied warranties, if any, are limited to the duration of the express warranty provided herein. Some states do not allow limitations on how long an implied warranty lasts so that the foregoing limitation may not apply to you. Some warranties are expressly VOID if the installer is not a licensed trained professional.

LIMITATION OF LIABILITY
In no event shall Pexheat.com or any of its employees, officers or affiliates be liable for any indirect, special, incidental or consequential damages including but not limited to material loss, loss of data, loss of business or profits. Some localities do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

ORDER PROCESSING
Your order is thoroughly reviewed by our Sales Department to ensure that the order is accurate, the payment method is valid, and you are authorized to use this payment method. Once your order has passed the rigorous review by our Sales Department, it is sent to our warehouse for shipment.

NOTE - An order with Pexheat.com is a promise to pay for any items shipped, information given, or services rendered by Pexheat.com or associate or supplier. We do not charge your credit or debit card until your order is shipped, however we do attempt to get an authorization on your card for the amount of your order at the time your order is placed. This authorization is not a charge but still may utilize a portion of your credit limit or available funds making those funds or portion of your credit limit unavailable for other use. In the event that your order is delayed or canceled the authorization may expire and your credit limit or available funds will again become available for use. The amount of time it takes for an authorization to expire is dependent on the policies of the bank that issued your card and ranges from 1 to 7 business days. In the event that your authorization has expired, Pexheat.com will attempt to get a new authorization on your card or bill your card for the remaining balance due on your order. If sufficient funds are not available on your credit card, Pexheat.com will contact you to arrange payment. It is the customers responsibility to arrange an alternative form of payment if your credit card prove insufficient to cover the balance of your account. Pexheat.com will continue to attempt to use your credit card to obtain the funds necessary to satisfy the balance due on the your account.

Please note, credit card processing can take up to 3 business days (Depending on the accuracy of the information given to us by the customer.). Further, for security reasons, voice confirmation may be required before we can process your credit card for payment.

If the item(s) on your order are in-stock, we will ship them as soon as possible from our warehouse or from one of our distribution warehouse or drop shipped from our suppliers located throughout the United States. If the item(s) on your order are out of stock, they will not be shipped until we have received and processed the backordered inventory in our warehouse.

TRANSIT TIME
UPS Ground: 1 - 8 Business Days
UPS 3 Day Select: 3 Business Days
UPS Second Day: 2 Business Days
UPS Next Day Air: 1 Business Day

Truck Freight: Some of our products, like pallets of tubing, are too large to ship via UPS and must be delivered by truck. Prices will depend on the area of the country you live in. If your order requires Truck Freight carrier you will be contacted by email to establish details and cost.

Please note: Large shipments of tubing coils are susceptible to slight damage during shipment. Slight scratched and kinks are acceptable and No credit will be issued for tubing that has small scratches, or other minor flaws. These are construction materials and unless the integrity of the tubing is destroyed they are still useable. Please contact us if you have any questions about your items. Accepting delivery of any damaged freight and failing to notify the driver or signing the freight bill at time of delivery means you have signed off on the freight. Please inspect your items before the carrier leaves. All items are noted that are shipped by truck.

CARRIERS AND PACKAGE SIZES
Your orders may come in multiple packages. In order to bring you a larger selection of products, we may ship items from different locations around the country. Therefore, your order may come in multiple packages on different carriers. There is no additional charge for broken shipments but you may get more than one tracking number for an order. Note: Saturday & Sunday deliveries are not available except by arrangement with our sales staff.

TOTAL TIME FOR DELIVERY
Total time is based on the amount of time it takes to get payment authorization, order processing, and the transit time from the carrier. This can range from 24 hours to 10 days for in-stock items.

TRACKING YOUR SHIPMENTS
The tracking number(s) for your order will be emailed to you when shipped. You will also be able to access your tracking number by viewing your order under your Pexheat.com account. If your order is shipped by Truck Freight, you will be notified of the carrier and how to contact them.

SHIPPING AND HANDLING RATES
Our customer-friendly shipping schedule is calculated on the ACTUAL WEIGHT of your shipment and the TYPE OF SHIPPING SERVICE that you specify (ground, air or overnight). Shipping and handling charges will be applied to all orders placed with us. We currently offer free ground shipping on orders over $1,000 (except orders containing subfloor products) shipped within the contiguous United States. Orders over $1000 containing "subfloor" panel products, will receive a 50% shipping charge discount. If your order must be shipped in multiple boxes, or in separate shipments in the event an item is not in stock and must ship at a later date, additional shipping and handling charges may be assessed to your account. Credit / Debit Card Authorizations
An authorization on a credit or debit card is a hold against your banks credit card spending limit. When the goods are shipped, a charge for the total amount of the order shipped will be sent to your credit card bank. Your bank should release the authorization when the charge is received. A charge is the only time a transfer of funds is completed; an authorization is not a transfer of funds.


Deposits
Pexheat.com may take a deposit from you to secure payment for our design or consultation services. This is a NON-REFUNDABLE deposit. Your authorization of this deposit order is a promise to pay for our design or consultation services. This deposit may be used to pay for material purchases, or it may be fully or partially refunded to you when you place an order for material. This deposit may be taken in the form of a credit card authorization such that funds are not actually taken from your credit card account. Pexheat.com may decide to take these funds at any time or allow the authorization to expire. If the credit card authorization has expired Pexheat.com may decide to re-authorize your credit card deposit or take payment in funds from your credit card. This deposit will be kept as a non-refundable credit in your account for a total of 1 year from the deposit order date. After 1 year the credit will be forfeited and the funds will not be refunded. Return policy and limited guarantee against defects
We, at Pexheat.com, always hope that our customers are both happy and satisfied with their purchases. But we accept that problems occur, especially when buying over the Internet, and you may wish to return items. If this is the case, please read our returns policy below.

Every third party product you buy from Pexheat.com is backed first by the product manufacturer's warranty. Pexheat.com's 30 day limited warranty against defects, may also apply. Pexheat.com's 30 day limited warranty is a defective exchange policy that provides for either repair or replacement (at our sole discretion) of merchandise that has been confirmed as defective by either the manufacturer or Pexheat.com. Items confirmed as defective by the product manufacturer or Pexheat.com will either be exchanged or repaired at our sole discretion within the first 30 days of ownership only. After 30 days the product manufacturer warranty is the only warranty in effect. Terms and conditions may vary by product or manufacturer. Pexheat.com will assist customers whenever possible in gaining satisfaction with product manufacturers.

Returns of Tubing and non-Electronic parts:
You may return your purchase if you are, for any reason, unhappy with the product(s). The package must be returned within 30 days of receipt of goods and all products must be returned in their original condition. We will issue a RMA (Returned Merchandise Authorization) number that must be prominently displayed on the packaging. We will issue a refund for the amount paid upon receipt of the item(s). There may be up to a 25% re-stocking fee applied to the refund.

Returns of Electronic Products:
You may only return an Electronic product if it is sent in the original unopened packaging. The package must be returned within 30 days of receipt of goods. We will issue a RMA (Returned Merchandise Authorization) number that must be prominently displayed on the packaging. We will issue a refund for the amount paid upon receipt of the item(s). There may be up to a 25% re-stocking fee applied to the refund.

Returns of Damaged or Defective Items:
You may return any item that is damaged or defective within 30 days of receipt of goods. We will issue a full refund for the amount paid.

Delivery Charges for Returns:
If you are returning items because they are damaged or defective, or due to an error on our part, we will refund your costs in returning the items to us. Otherwise you will be responsible for return postage.

How to Return an Item:
For assistance or to exchange a defective product click here to get an online return authorization number. Products returned for exchange must be in new condition, original packaging and include all, registration cards, packing materials and other accessories and be received within 30 days of the invoice date. We reserve the right to refuse for return or charge a restocking fee for damaged or incomplete returns. No returns will be accepted without an RMA number issued by Pexheat.com or when the product manufactures or distributors return policies supersede ours. If you wish to return an item, please ontact us by email or phone immediately. If a product is damaged or defective please indicate the exact nature of the fault. Repackage the product(s), complete with all accessories, warranty cards, instructions and original boxes (if any). When we issue you an RMA number we will tell you where to send the package.

We recommend using a tracked-delivery service for you own protection.

Risk of Loss
If the Customer provides Pexheat.com with Customer's carrier account number or selects a carrier other than a carrier that regularly ships for Pexheat.com, title to products and risk of loss or damage during shipment passes from Pexheat.com to Customer upon shipment from Pexheat.com's facility or suppliers facility due to a drop shipment. For all other shipments, title to products and risk of loss or damage during shipment passes from Pexheat.com to Customer upon receipt by Customer. Pexheat.com retains a security interest in the products until payment in full is received. Customer will be responsible for all return shipping and related charges.

Export Policies
If this transaction involves an export under the U.S. export regulations, the commodities, technology and/or software sold or distributed under these terms and conditions of sale exported from the United States by Pexheat.com were exported in accordance with such regulations. Diversion, use, export or re-export contrary to United States law is prohibited. The customer is responsible for any additional Import/Export duties, taxes, or customs fees incurred on shipments outside the United States. In the event that a return is necessary, the customer is also responsible for any and all duties, taxes, or customs fees incurred on shipments back into the United States. In addition, manufacturers' warranties for exported products may vary or may be null and void for products exported outside the United States.

Dispute Resolution
AGREEMENT TO RESOLVE ALL DISPUTES THROUGH ARBITRATION OR IN SMALL CLAIMS COURT AND AGREEMENT TO WAIVE A RIGHT TO JURY TRIAL AND TO PARTICIPATION IN CLASS ACTIONS

You and Pexheat.com agree to resolve any controversy, dispute, or claim arising out of or relating to your purchase of any product or service from Pexheat.com by binding Arbitration administered by the American Arbitration Association, or in a small claims court, and judgment on the arbitration award rendered by the Arbitrator(s) may be entered in a court having competent jurisdiction. This agreement to arbitrate is intended to be broadly interpreted and covers all controversies, disputes, claims arising out or relating to your purchase including, but not limited to contract claims, tort claims and statutory claims, or any combination of claims. We agree that the arbitration or small claim proceeding will take place in Suffolk County, New York.

We agree that the American Arbitration Association shall administer the arbitration, and that the American Arbitration Association's Commercial Arbitration Rules and Mediation Procedures and Consumer Related Disputes Supplementary Procedures, if applicable, shall apply. These Arbitration Rules may be found on the American Arbitration Association's web site at www.adr.org . You and Pexheat.com agree that the Arbitration Award maybe taken to a Court of competent jurisdiction to become an enforceable judgment. You and Pexheat.com agree that any arbitration under this Agreement will take place on an individual basis. Class arbitration and class actions are not permitted.

If you wish to begin arbitration against Pexheat.com you must file a case with the American Arbitration Association. You may visit the American Arbitration Association's web site at www.adr.org to obtain forms and guidance and to learn the procedure for filing a case under this Arbitration Agreement.

This Arbitration Agreement affects you legal rights. An arbitration is resolved by a neutral party and not a judge or jury. There is less discovery and less exchange of information between the parties to an arbitration than might occur in a court proceeding. An arbitration award is final and binding and will only be overturned or reversed by a court in very limited circumstances. You agree that, by entering into this Agreement, you and Pexheat.com are each waiving the right to a trial by jury or to participate in a class action.
